So, if an ISP had control of this system and provided content filtering, would that then mean that they are not covered by the Safe Harbour provisions because they are doing content filtering? So if anyone managed to get some porn or other stuff served to them that was supposed to be blocked, I could potentially sue them for allowing it through?
